Knowing that Islam plays a very significant role in politics in the Middle East and across the world, this seminar will focus on illustrating the stance of the Islamic Shari’ah on the transitional justice in the post-conflict societies. In this regard, it places greater emphasis on the historical precedents of the different jurisprudential trends in the Islamic Shari’ah towards the post-conflict situation in attempt to establish an Islamic legal basis for transitional justice. The seminar adopts the analytical, comparative, critical and historical approaches and concludes that transitional justice is admissible to apply in the periods of political transition in countries, which are on track to achieve the political reform if specific legal conditions are in place.
